They have not been charged with any crime.
Their arrests are part of a controversial law enforcement tactic that allows US Immigration and Customs Enforcement, commonly called ICE, to hold people for civil immigration violations while investigators attempt to build criminal cases against them.
Keeps them busy I guess.
Federal officials say it is a valuable tool in the fight against terrorism, and its use increased after the Sept. 11, 2001, terrorist attacks.
The fallout from that fateful day extended far beyond tower dropping at free-fall speed into their own footprint.
But civil liberties advocates and others say the government is sidestepping the criminal process by limiting detainees’ access to lawyers and keeping them in jail. Some analysts say the tactics used by ICE could also alienate immigrant communities that are vital to helping solve crimes and preclude chances of wider evidence gathering.
“I think there’s an overuse of ICE in these cases,’’ said Vincent M. Cannistraro, who led counterterrorism operations for the CIA until 1991 and now issues a newsletter on global security issues from Virginia. “If you suspect that they’re there, watch them. You can tap their phones. You can basically monitor their activities until you do get the information you need.’’
An "ex"-CIA guy says?
While police, the FBI, and other law enforcement agencies require evidence of crimes to arrest people, immigration officials require only a violation of the civil immigration law, such as an expired visa....
Authorities can use immigration laws, including the threat of deportation, as leverage to get information.
Why not just torture them because I've been told that works?
Earlier this year, New York subway bombing suspect Najibullah Zazi increased his cooperation with authorities after they threatened to charge his mother with immigration offenses and after they charged his Afghan-born father with crimes, according to an account in The Washington Post.

FBI spokeswoman Gail Marcinkiewicz said ICE is a key part of the Joint Anti-Terrorism Task Force in Boston, where federal, state, and local agencies regularly collaborate on antiterrorism efforts, she said.
“The reason we have task forces in this day and age is that not any one law enforcement agency can do it alone,’’ she said.
But civil liberties groups say the broad use of immigration laws leaves the system vulnerable to abuses. ICE and the immigration courts are not subject to the same public scrutiny as are the police and the regular court system. ICE routinely refuses to release detainees’ names, and their court files are not available to the public.
The agency has jailed 27-year-old Baskaran Balasundaram, a Sri Lankan, for nearly two years on concerns that he provided support to a terrorist group in his homeland, even though he said he had been kidnapped by them and forced to live like a slave. In 2009, a federal judge granted him asylum based on his story of kidnap and, later, torture by the Sri Lankan Army, but he remains in jail. The American Civil Liberties Union of Massachusetts is fighting in court for his release.

“Their public face is that they’re using immigration as a tool of law enforcement and say they’re really going after the worst of the worst,’’ said Laura Rótolo, staff attorney for the ACLU of Massachusetts. “But in reality, they’re deporting increasing numbers of people’’ who have not been convicted of crimes....

Donald Kerwin — vice president of programs at the Migration Policy Institute, a nonpartisan think tank based in Washington — said the government should make national security the priority. The risk of detaining people for immigration violations, he said, is that if the government fails to build a criminal case against them, they may end up deporting them and setting them free in their homelands.
“That’s where the rationale falls apart,’’ Kerwin added. “If you really suspect that somebody was a terrorist sympathizer or somebody who provided material support, unless there was no possibility of a criminal case against them, why would you release them to their country of nationality where they could stage attacks against the United States?’’
Brian Kyes, police chief of Chelsea, the city with the state’s highest percentage of immigrants, said police in immigrant communities often walk a fine line with ICE to keep their communities safe. He makes clear that Chelsea police do not enforce federal immigration law, so that immigrants feel comfortable reporting crimes whether they are in the country legally or not.
But, Kyes said, he willingly works with ICE to arrest violent criminals and gang members....

NEW YORK — Thousands of mentally disabled immigrants are entangled in deportation proceedings each year with little or no legal help, leaving them distraught, defenseless, and detained as their fates are decided, according to a report issued yesterday by Human Rights Watch and the American Civil Liberties Union, which exhorted federal authorities to do better.
Shortcomings outlined by the two groups include no right to appointed counsel, inflexible detention policies, insufficient guidance for judges on handling people with mental disabilities, and inadequately coordinated services to aid detainees.

“No one knows what to do with detainees with mental disabilities, so every part of the immigration system has abdicated responsibility,’’ said Sarah Mehta, the report’s lead author. “The result is people languishing in detention for years while their legal files — and their lives — are transferred around or put on indefinite hold.’’

The federal agencies involved in the deportation system are well aware of many of the problems cited in the report, and Mehta said she has been cautiously encouraged by some recent steps to better handle people with mental disabilities.
For example, US Immigration and Customs Enforcement, the agency which arrests and detains people facing deportation, will host a national forum in September seeking input from mental health experts on ways to improve its practices.

SAN ANTONIO — In an agreement US immigration officials hope will begin to reshape the entire 30,000-bed detention system, some asylum-seekers and immigrants awaiting deportation proceedings could soon be held in facilities where they can wear their own clothes, participate in movie and bingo nights, eat continental breakfasts, and celebrate holidays with visiting family members.
So it will be like a VACATION, huh?
And that foreclosed American living in the tent city outside of town?
It could end confinement in prison-like facilities — complete with razor wire, jail-style uniforms, armed guards, and partitions that prevent physical contact with loved ones — for those never convicted of a crime or considered a threat.
Corrections Corporation of America, the largest contractor for US Immigration and Customs Enforcement, has reached a preliminary agreement to soften confinement, free of charge, at nine immigrant facilities covering more than 7,100 beds — a deal that ICE officials see as a precursor to changes elsewhere.
NO WONDER the immigration problem is NEVER $OLVED!
Overall, the facilities are expected to be less prison-like, offering freer movement for detainees, fewer patdowns, and better access to legal resources. The agreement calls for fresh vegetables and access to self-serve beverages along with cooking and exercise classes, according to a list released by ICE.
CCA will soften “the look for the facility with hanging plants, flower baskets, new paint colors, different bedding and furniture’’ and allow lengthy visits from friends and family who can provide packages or food for special celebrations under changes over the next six months....
Many are held only a few nights before being deported, while others — particularly those seeking asylum from persecution in their home countries — can stay in custody for months or years while their cases are decided by an overburdened immigration court system....

Medical staff at the Suffolk County jail waited too long in October to send a feverish and trembling immigrant detainee to the hospital, allowing a deadly bacterial infection to overtake his body and cause his death of heart failure at age 49, according to a report by the federal immigration agency obtained by the Globe.
Pedro Tavarez, a Providence shuttle driver who was being held for deportation to the Dominican Republic, died Oct. 19 at a Boston hospital after a rapid decline that raised questions about medical care and government oversight at the Boston jail.
In Massachusetts?
Officials at the Suffolk County House of Correction have said that the infirmary, run by Tennessee-based Prison Health Services Inc., provides good care and has received high marks by reviewers.

Tavarez’s death highlighted longstanding concerns about the medical care of immigrant detainees, who are held in federal, local, and privately run jails across the country. In 2008, federal officials removed immigrants from the privately operated Wyatt Detention Facility in Central Falls, R.I., after a 34-year-old Chinese citizen was denied medical treatment shortly before he died of cancer.

The Obama administration is in line to deport around 400,000 immigrants this year, a number slightly higher than during the Bush administration, but federal officials have pledged to improve the detention system.

In June, the head of US Immigration and Customs Enforcement, John T. Morton, said seriously ill immigrants should not be jailed “absent extraordinary circumstances’’ or unless the law requires it.
Well, maybe they should be put in a hospital.
Advocates for immigrants have urged officials to reduce detentions, saying medical care lacks proper oversight from the federal government....
I think we could use that across the board in AmeriKa. Time to sort out who should be in there and who should not.
Tavarez, who had a daughter, came to the United States as a legal immigrant in 1976. He had three minor drug-related convictions, and an immigration judge ordered him deported in 1998.
He eluded authorities until April 2008, when Rhode Island State Police stopped him for a traffic violation and turned him over to ICE....

British spies have not been accused of torturing detainees, but several former suspects have alleged that British officials were complicit in their mistreatment while they were held by agents from the United States, Pakistan, and other countries, because they knew of abuse but did not stop it.

Prime Minister David Cameron told lawmakers in the House of Commons that “for the past few years the reputation of our security services has been overshadowed by allegations about their involvement in the treatment of detainees held by other countries.’’

“It is time to clear up this matter once and for all,’’ he said.
Translation: They are working on the cover-up.
Cameron said the government would ask the 12 to drop their lawsuits in exchange for mediation, possible compensation, and a promise the inquiry will investigate their assertions.
He said the inquiry also cannot start until the conclusion of a criminal investigation underway into allegations against two officers from the MI5 and MI6 intelligence agencies....
The panel is expected to call current and former ministers and intelligence agency chiefs to give evidence, but it is unclear how much of it will be in public. Cameron said intelligence officers would not be required to give evidence publicly.
Gibson is the Intelligence Services commissioner, a watchdog for Britain’s spies....

LONDON — Britain’s Supreme Court threw out a plan yesterday to offer troops at war protection under human rights law, saying the policy could leave military commanders concerned more about legal issues than enemy fire.

Six of nine justices overturned a lower court decision that the Human Rights Act should apply to soldiers everywhere. The court said human rights legislation was never intended to apply to forces fighting on foreign soil.
Activists had hoped having the troops subject to the human rights act would strengthen the ability of soldiers or their next of kin to sue the government in cases where deaths and injuries may have been caused by faulty or missing equipment.

Justice Alan Rodger said in the ruling that “deaths and injuries are inevitable’’ in battle.
So is the fall of empires. I would expect you to know that.
“To suggest that these deaths and injuries can always, or even usually, be seen as the result of some failure to protect the soldiers . . . is to depreciate the bravery of the men and women who face these dangers,’’ he said.
And will cause war-profiteering profits to fall.
Britain’s military had argued that it could not guarantee the same protection for troops patrolling an Afghan market as it does to those working in bases or training in the UK.

Ministry lawyer James Eadie had argued that the earlier ruling would probably have an impact on tactical decisions made by commanders in combat situations — who would have the added burden of considering the legal implications of their choices.
“This outcome is not about denying rights to our people, it is about ensuring that we have a clear and workable set of rules under which they can carry out their demanding and dangerous work,’’ said Air Chief Marshal Jock Stirrup, head of the British armed forces.
The ruling centered on a case related to the death of Private Jason Smith, 32, who died of heatstroke on a British Army base while serving in Iraq in 2003.
Smith, a reservist, repeatedly told medics he felt unwell due to soaring temperatures, which topped 122 degrees Fahrenheit. He later suffered a heart attack and was found dead.
An inquest into Smith’s death found the military failed to address the difficulty he had in adjusting to the climate. A second inquest, which will consider whether his human rights were violated, has been ordered by a lower court....
Justices said it was unlikely that when European human rights legislation was drafted after World War II it was “regarded as desirable or practicable’’ to be applied to troops overseas, but they advised that the issue be resolved at the European Court of Human Rights in Strasbourg, France.

Intelligence officials began unraveling the subway plot last year, when US intelligence intercepted an e-mail from an account that Al Qaeda had used in a recent terrorist plot, officials said.

The e-mail discussed bomb-making techniques and was sent to an address in Denver, setting off alarms within the CIA and FBI from Islamabad to the United States.
Najibullah Zazi and two friends were arrested in September 2009 before, prosecutors said, they could carry out a trio of suicide bombings in Manhattan....

A fourth suspect, a midlevel Al Qaeda operative known as Ahmed, traded the e-mails with Zazi, who was frantically trying to perfect his bomb making recipe, officials said. The United States wants to bring the Pakistani man here for trial on charges that are not yet public.
Pakistani officials also have arrested a fifth person, known as Afridi, who worked with Ahmed, officials said.
The FBI and US attorney’s office in Brooklyn had no comment yesterday.
The meeting with Shukrijumah is among many new details officials disclosed about how the men hooked up with Al Qaeda. The new account provides a rare glimpse into Al Qaeda’s recruiting process.

Shukrijumah had spent much of his youth in Brooklyn and in Florida. He received flight training at around the same time as the 9/11 hijackers and became the focus of intense concern among federal authorities, in part because he spent so much time in the United States and was familiar with the language and culture.

In 2004, Attorney General John Ashcroft called Shukrijumah a “clear and present danger’’ to the United States. The United States is offering a $5 million reward for information leading to his capture.
The new indictment charging a conspiracy to use weapons of mass destruction alleges that Shukrijumah and Ahmad recruited Zazi, Ahmedzay, and Medunjanin in 2008 to receive training from Al Qaeda in the Waziristan region of Pakistan.
Once the three former high school classmates from Queens returned to the United States in early 2009, the indictment adds, Ahmad traded coded e-mail messages with both Zazi and Naseer, who was part of a cell based in Manchester, England.
Prosecutors said that in one message, Naseer told Ahmad he was planning a large “wedding,’’ code for attack. Likewise, prosecutors said, Zazi e-mailed Ahmad that “the marriage is ready’’ shortly before he drove from Colorado to New York City carrying bomb-making components in September 2009.
In a search of the British suspects’ homes, investigators found large amounts of flour and oil, and surveillance photos and maps of Manchester on the walls, prosecutors said.
Zazi, who was under FBI surveillance, was arrested after abandoning the plan and fleeing back to Colorado. Naseer is in custody in the United Kingdom on terrorism charges; Rehman was deported to Pakistan.
The indictment contained few details on the connection between the alleged plots in New York and Manchester. The news release announcing the indictment simply says that “the charges reveal’’ that the planned subway attack was “directly related to a scheme by Al Qaeda plotters in Pakistan to use Western operatives to attack a target in the United States.’’
The new indictment was unsealed on the fifth anniversary of a suicide attack on London’s transit system that killed 52 commuters.

NEW YORK - Two men linked to an alleged Al Qaeda associate accused in a plot to attack New York City with homemade bombs were arrested yesterday after one of the men caused a traffic accident while under surveillance.
Zarein Ahmedzay pleaded not guilty to a false statement charge in an indictment accusing him of lying to the FBI about a trip to Pakistan and Afghanistan. The other suspect, Adis Medunjanin, remained in custody, and it was unclear when he would appear in court.
You see, the government can lie to you and then they can charge you with lying to them. Anybody catch a whiff of fascism?
Two law enforcement officials familiar with the case said earlier yesterday that Medunjanin was facing possible charges of providing material support to terrorism. The officials were not authorized to discuss the case and spoke to the Associated Press on condition of anonymity.
During a brief appearance in federal court in Brooklyn, Ahmedzay, 24, was ordered held without bail until a hearing Tuesday. Defense lawyer Michael Marinaccio said the indictment made no mention of terrorism. “It seems to me that if [prosecutors] had that kind of information, we’d be reading about it in the indictment,’’ he told reporters outside court.

Ahmedzay and Medunjanin were first publicly linked to the investigation in September, when investigators raided their homes shortly before the arrest of their old Queens high school classmate Najibullah Zazi, a Colorado airport shuttle driver who has pleaded not guilty to supporting terrorism. The latest arrests came after the FBI went to Medunjanin’s Queens apartment Thursday afternoon with a search warrant and seized his passport.
So the FBI was harassing him.
After the search, he apparently became upset and left in his car. While driving erratically, Medunjanin called 911 and made angry comments referencing Allah, the law enforcement officials said. He got into an accident and was treated at a hospital for minor injuries.
So he was BASICALLY PROVOKED into ROAD RAGE!!
Federal authorities later took him into custody for questioning before deciding to arrest him early yesterday, the officials said. Agents arrested Ahmedzay at about 3 a.m. while he was driving a cab in the Greenwich Village section of Manhattan, authorities said.
“He’s not guilty,’’ Shried Ahmedzay, 22, his brother, said yesterday. “He works hard to support his family.’’ The brother said it was obvious that authorities had him under surveillance for months, noting that unmarked cars frequently parked around his apartment building.

FBI agents arrested Mohammed Wali Zazi yesterday at his home in a Denver suburb after a previous charge, lying to the government, was dropped. He had been out on bail.

A new indictment unsealed in federal court in Brooklyn accused Zazi of conspiring with others to destroy or hide “glasses, masks, liquid chemicals, and containers’’ that were evidence in a foiled terrorism plot....

While entering the city, he was stopped by police for a routine traffic violation on the George Washington Bridge, which connects New Jersey and New York. Police allowed him to go free, but were suspicious and kept a close watch on his movements.

Days later, authorities raided several Queens apartments, including a friend’s home where Zazi had stayed.... A law enforcement official familiar with the case told the AP that Zazi was spooked by the traffic stop and flushed the explosive materials down the toilet after arriving in New York....

One of the people familiar with the Zazi case told the AP that Zazi decided to cooperate after being warned that his mother could face criminal immigration charges. The officials spoke on condition of anonymity because the investigation is in progress.

Jeffrey H. Knox, assistant US attorney overseeing the case, told the court that it is likely other defendants would be charged in the case. The men abandoned the attack in September just days before planning to carry it out, after realizing they were under government surveillance.

NEW YORK - Investigators seeking to uncover terrorist plots for years have walked a fine line between keeping tabs on the Muslim community and alienating the same people who could serve as an early warning signal.
That tenuous balance has been tested again in what law enforcement authorities say is one of the most worrisome terror investigations in decades, the unfolding case against Denver shuttle bus driver Najibullah Zazi, who has been charged with conspiracy to unleash weapons of mass destruction in the form of hydrogen peroxide bombs.
That they NEVER FOUND!!!!
A Queens man who had been a power broker in his Muslim community - and a source for the New York City Police Department - allegedly tipped off Zazi of the police interest early last month. That complicated the ongoing investigation of what investigators say were Al Qaeda operatives on American soil, and led to the indictment of the Queens man on criminal charges.
Now why no mention that the "police source" is an imam in the mosque?
Tension among the FBI, local police, and members of the Islamic community has flared several times in the years since the Sept. 11, 2001, terrorist strikes. Earlier this year some Muslim charities and advocacy groups threatened to cut ties with the FBI amid concern that investigators were infiltrating mosques in California and elsewhere. FBI leaders say they have tried to strengthen ties to Muslims through advisory councils, community group meetings, and other contacts. Building such relationships is important because investigators, who often lack language skills and deep understanding of immigrant enclaves, must rely on insiders to help guide them through the maze of cultural issues.

“Your job is to know everything that’s going on in that mosque - everything,’’ said Jack Cloonan, a retired special agent for the FBI who worked in the Afghan community in Queens from the late 1980s until 2002. “What is going on in this community? Do I know what’s going on within the mosque? Do I know who’s coming in? Do I know what’s going on in terms of criminal activity? Who will know this?’’
By all accounts, that type of thinking inspired police last month to approach Ahmad Wais Afzali, 37, a Flushing community leader who had helped agents in the past, and ask him to “find out everything you can’’ about the 24-year-old Zazi - “who he is, where he is, where he’s going,’’ said Afzali’s lawyer, Ronald Kuby. They did not tell Afzali why they were looking for the younger man, Kuby said.

Afzali, who had prayed alongside Zazi in various mosques for years, used his network of contacts to track down Zazi’s phone number and eventually called and explained he was in touch because the police had asked about Zazi, said Kuby. Afzali, who has denied wrongdoing, sometimes preached at mosques and also ran the Islamic Burial Funeral Service, a funeral parlor in Queens. His business card was on the bulletin boards of Afghan mosques, and he had entree to the homes and intimate moments of a broad swath of Afghan immigrants.
“If somebody dies in the family, he’s the only person we trust,’’ said a 31-year-old restaurant cook who gave his name only as Nabi, and whose father was buried by Afzali last year. “People are scared,’’ said a 36-year-old Flushing man who declined to give his name. “They’re scared that if they work with the police they’ll get hurt, and if they don’t work with the police they’ll get hurt.’’

The civil liberties concerns resounded again after the FBI released its Domestic Investigations and Operations Guide on Sept. 25 as part of a lawsuit by the Electronic Frontier Foundation and Muslim Advocates.
How did those get in there?
The guidelines amount to a road map for agents who are conducting investigations, but some of the most sensitive material, about agents’ undisclosed participation as informants stationed in mosques and churches, was blacked out in the report.

Nadhira al-Khalili, national legal counsel at the Council on American-Islamic Relations, said in a statement that the guidelines could “inevitably lead to violations of the Constitution and the right of all Americans to practice their faith without fear of government intrusion or intimidation.’’ CAIR and the American Civil Liberties Union called upon the Justice Department and Congress to overhaul the guidelines to ensure that FBI agents are acting in line with the law. But supporters of the guidelines say they were developed in consultation with religious and civil liberties groups, and were the subject of three congressional hearings.
